We guarantee this puppy for a period of Two (2) year from date of birth. All puppies
will be honestly represented and evaluated as accurately as possible before leaving
our premises. Buyer should have the puppy thoroughly examined by a licensed
veterinarian ( at buyers expense ) within 3 days( three days) of delivery. If buyers
veterinarian finds cause for return such as an incurable illness that will effect the life
span of the puppy purchased from Lambert Kennels, I Lewis Lambert must be
notified Immediately, and same puppy must be returned to Lambert Kennels within 4
days ( four days) of purchase date.
If within 3 days ( three days ) from the time the buyer takes possession of the puppy,
it is found by a licensed veterinarian not to be in good health, ( internal, external,
parasites , Demodicosis , skin allergies , Cherry Eye, Hod and kennel cough
excluded ) it must be reported to seller within the 3 day ( three day ) time limit. We
will replace the puppy with a new one; If a replacement is unavailable at that time
seller will have 1 year ( one year) to replace puppy with another of equal or greater
value. During that time buyer will be given a voucher for the puppy and notified
immediately when another puppy is available. Seller reserves the right to have the
puppy examined by a veterinarian of sellers choice, before exchange is made. It is
the sole responsibility of the buyer to provide immediate veterinary care to any
puppy showing signs of illness, and failure to do so will render any guarantee null
and void. Under no circumstance is a puppy to be destroyed prior to notification of
seller. If a puppy dies within the guarantee period, despite medical treatment,
replacement will be made ONLY if a veterinarian certifies the cause of death. Seller
will not be held liable for any medical or behavioral problems due to transit.
Replacement will be made only upon the return of original puppy with AKC / other
registration papers to Lambert Kennels. If death occurs an autopsy will be required
for a replacement.
Puppy is guaranteed against genetic defects only. All guidelines must be followed or
contract will be void.
A) The buyer must notify seller of any genetic defect immediately.
B) A written statement as to the genetic defect must be provided to us from buyers
veterinarian.
C) A written second opinion from another veterinarian must be provided to us from
buyer.
D) Sellers veterinarian will examine the puppy. After these guidelines are followed,
if there is a genetic
Defect present we will provide a replacement puppy of the same value of original
purchase
Price. Original puppy must be returned back to Lambert kennels prior to
replacement.
In the event this should occur , and the buyer chooses to relinquish ownership of the
puppy to Lewis Lambert at (Lambert Kennels), the puppy will be replaced, less any
shipping or miscellaneous charges necessary for transportation of puppies to / from
this location. AKC / other Reg. papers with a signed transfer must accompany the
puppy.
Lewis Lambert (Lambert Kennels) will NOT be held liable for any medical or
miscellaneous expenses incurred after puppy leaves Lambert Kennels.
Show / Breeder quality, or size of puppy at adulthood will NOT be guaranteed.
This contract supersedes any and all previous agreements.
Once puppy has been paid for there will be NO refunds
This contract is null and void if the terms and conditions are not fulfilled or / and if the
contract is not signed , notarized ,and returned back to Lambert Kennels within 3
(three) weeks of purchasing your puppy.
If buyer decides they cannot keep the puppy/adult dog for any reason , Lambert
Kennels must be notified and given first choice to obtain puppy/ adult dog back, with
Full reg. Papers.
This warranty is null and void if :
1) The buyer does not maintain preventative health care of the puppy/dog, including,
but not limited to inoculations, internal and external parasites and heartworm
preventative medicine.
2) The puppy / dog is chained , tied , or left alone in a kennel.
3) The puppy / dog is not kept under veterinarian care. ( check up every 3 (three)
months.
4) The puppy / dog has been bred.
This agreement is made and entered into the state of Kentucky, and shall be
enforced and interpreted under the laws of this state.
I the buyer of a puppy / dog from seller hereby acknowledge that I have received a
copy of this document. Further more, I accept the terms and conditions of this
guarantee / contract for congenital or hereditary disorders printed in this document,
and I waive and relinquish any and all other rights that I might otherwise have in the
event of such occurrence. In the event of any litigation in connection with this
guarantee / contract, seller will be paid reasonable attorney fees by the buyer. Venue
and jurisdiction for litigation arising out of or related to this guarantee / contract shall
lie exclusively in sellers county and state.
Buyer acknowledges that he or she has read, understands and agrees to the terms
and conditions of this document.
